This Indenture Made the ninth day of July in the year of our Lord one thousand seven hundred and seventy four Between Martin Mohler of Cocolico Township in the County of Lancaster and Province of Pennsylvania yeoman of the one part and John Landus of the same place yeoman of the other part. WHEREAS the said Martin Mohler in and by ten certain bonds or obligations under his hand and seal bearing even date herewith standeth bound unto the said John Landus in the sum of four hundred and thirty six pounds four shillings lawful Money of Pennsylvania Conditioned for the payment of two hundred & eighteen pounds two shillings lawful money aforesaid to be paid in the following manner to wit the sum of twenty pounds thereof on the first day of May next and the further sum of twenty pounds thereof on the first day of May which will be in the year of 1776 and the further sum of twenty pounds thereon on the first day of May which will be in the year of 1777 and the further sum of twenty pounds thereof on the first day of May which will be in the year of 1778 and the further sum of twenty pounds thereof on the first day of May which will be in the year of 1779 and the further sum of twenty four pounds on the first day of May which will be in the year of 1780 & the further sum of twenty four pounds on the first day of May which will be in the year of 1781 and the further sum of twenty four pounds thereon on the first day of May which will be in the year of 1782 and the further sum of twenty four pounds thereon on the first day of May which will be in the year of 1783 and the further sum of twenty two pounds two shillings as the remainder part thereof on the first day of May which will be in the year of 1784 as in and by the said recited bonds and conditions thereon relation thereunto being had may more fully and at large appear.
NOW THIS INDENTURE WITNESSETH That the said Martin Mohler for an in consideration of the said debt or sum of two hundred and eighteen pounds two shillings lawfull money aforesaid and for the better securing the payment thereof unto the said John Landus his heirs executors administrators and assigns in discharge of the said recited bonds and in consideration of the of the further sum of five shillings by the said Martin Mohler in hand well and truly paid at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged hath granted bargained sold released & confirmed and by these presents doth grant bargain sell release and confirm unto the said John Landus his heirs and assigns by these presents
ALL THOSE TWO CERTAIN pieces parcels or tracts of land situate in Cocolico Township aforesaid which lying contiguous make an entire tract BEGINNING at a post corner on the bank of Cocolico Creek thence down the same the several courses & distances thereof forty two perches to a post corner thence by land of George Mergel the six courses and distances next following to wit North fifty degrees West nineteen perches and an half to a post thence West twenty two perches to a post thence North sixteen degrees East twenty nine perches and an half to a post thence South eighty three degrees East thirty one perches to a post Thence North sixty one perches to a post thence North thirty five degrees West three hundred perches to a post in a line of Jacob Kellars land thence by the same East by North forty four perches and an half to a post thence by land of John Mohler South thirty one degrees East three hundred and sixty perches to a post thence by land of John Heaffly South fifty seven degrees West fifty four perches to a post thence by the same South forty four degrees East twenty five perches to the place of Beginning Containing ninety eight acres of land and allowance of six pcent.
TOGETHER WITH all and singular the buildings & improvements thereon erected and built and all ways woods waters water courses rights members priviledges hereditaments and appurtenances whatsoever to the same belonging or in any wise appertaining & the reversion's and remainders, TO HAVE AND TO HOLD the said tract of land above described with the appurtenances unto the said John Landus his heirs and assigns to the only proper use and behoof of him the said John Landus his heirs and assigns forever. PROVIDED ALWAY NEVERTHELESS That if the said Martin Mohler his heirs executors administrators or assigns shall and do well and truly pay or cause to be paid unto the said John Landus his heirs executors administrators or assigns the aforesaid debt or sum of two hundred and eighteen pounds two shillings lawfull money aforesaid on the days and times herein mentioned and appointed for payment thereof according to the condition of the said bonds or obligations without any fraud or further delay & without any deduction defalcation or abatement to be made or any thing for or in respect of any taxes charges or assessments whatsoever then and from thenceforth as well this present Indenture and the estate hereby granted as the said recited bonds shall cease determine & become absolutely null and void to all intents and purposes whatsoever anything herein contained to the contrary in any wise notwithstanding. LANCASTER COUNTY, SST: Before me the subscriber one of his Majesties Justices of the Peace for said County came the above named Martin Mohler & acknowledged the herein written Indenture of Mortgage to be his act and deed & desired that the same might be recorded as such.
