This Indenture made the Seventeenth day of February in the year of our Lord one thousand seven hundred and ninety two Between John Mohler of Cocolico Township in the County of Lancaster and Sate of Pennsylvania Yeoman and Ann his wife (the said Ann being the Daughter of Daniel Bollinger Late of the Township of Cocolico in the County of Lancaster aforesaid Yeoman deceased of the one part and Peter Bollinger of the said Township of Cocolico in the County of Lancaster and State of Pennsylvania aforesaid Yeoman (the Son of the said Daniel Bollinger deceased) of the other Part Whereas the honorable Thomas Penn and Richard Penn Esquires (late) Proprietaries of Pennsylvania aforesaid in and by their certain Patent or Grant bearing date the thirteenth day of December in the year of our Lord one thousand seven hundred and fifty three for the Considerations therein mentioned did give grant release and confirm unto a certain Jacob Weiss a certain Tract or Piece of Land Situate in the said Township of Cocolico in the County of Lancaster aforesaid bounded and described as follows to wit Beginning at a Post Standing on Middle creek and from thence extending by Land (then) of George Michael Weiss, the six Courses and distances next following vizt: North seventy seven degrees East eighty Six Perches to a marked Hickory South ten degrees East forty eight Perches to a post North eighty one degrees East fifty three Perches to a marked Hickory North fourteen degrees East eighteeen Perches to a marked Hickory North Seventy eight degrees East thirty six Perches to a marked Hickory and North fifty two degrees East two hundred and Sixty Perches to a post thence by the Land then of Adam Wand North Sixty one degrees West Sixty tow perches to a marked Hickory thence by George Weavers land South forty eight degrees West eighty seven Perches to a marked Hickory South fifty degrees East forty nine Perches to a marked White oak and North sixty seven degrees West one hundred and twenty five Perches to a marked Hickory thence by Land then of Hery Deardorf South fifty three degrees West Eighty Perches to a post and South eighty seven degrees West Sixty two Perches to a Post standing on the said Middle Creek thence down the same on the several Courses thereof one hundred and eight Perches to the place of Beginning Containing one hundred and forty Acres and the usual Allowance of Six Acres perCent for Roads and Highways with the Appurtenances To hold to him the said Jacob Weiss his Heirs and Assigns forever as in and by the said recited Patent or Grant Recorded in the office for recording of Deeds for the City and County of Philadelphia in patent Book A Vol 19: Page 163 &c reference thereto being had may more fully appear And Whereas the said Jacob Wiess and Sophia his wife in and by their certain Indenture bearing date the Sixth day of December in the year of our Lord one thousand seven hundred and fifty eight for the Consideration therein mentioned did grant bargain and sell unto the said Daniel Bollinger all that the above mentioned and described Tract or Piece of Land Containing One hundred and forty acres and the Allowance as aforesaid with the Appurtenances To hold to him the said Daniel Bollinger his Heirs and Assigns forever as in and by the said recited Indenture recorded in the office for recording of deeds for the County of Lancaster aforesaid in Book K Page 56 reference thereto being had may more at large appear. And Whereas the above named Thomas Penn and Richard Penn Esquires late Proprietaries of Pennsylvania aforesaid in and by their certain other Patent or grant bearing date the twenty seventh day of January in the year of our Lord one thousand seven hundred and Sixty two for the Considerations therein mentioned did give grant release and Confirm unto a certain George Michael Weiss a certain Tract of Land Situate in the Township of Cocolico in the County of Lancaster aforesaid Containing One hundred and forty Acres and the Allowance of Six Acres perCent for Roads and Highways according to the Courses and Distances Bounds and Limits in thesame Patent mentioned and described with their Appurtenances To hold to him the said George Michael Weiss his Heirs and Assigns forever as in and by the said recited Patent or Grant recorded in the Office for recording of deeds for the City and County of Philadelphia in patent Book A A Vol. 2: Page 479 &c Reference thereto being had may more fully appear And Whereas the said George Michael Weiss and Christina his wife in and by their certain Indenture bearing date the Sixteenth day of October in the year of our Lord one thousand seven hundred and Sixty seven for the Consideration therein mentioned did grant bargain and Sell unto the said Daniel Bollinger All those two certain Tracts or Pieces of Land (Parts and Parcels of the last mentioned Tract of Land which was granted and confirmed unto the said George Michael Weiss in and by the last recited Patent as aforesaid situate in the Township of Cocolico in the County of Lancaster aforesaid bounded and described as follows to wit one of them Beginning at a Stone where formerly a Hickory Stood a Corner of Land late of Jacob Weiss but then of the said Daniel Bollinger and thence extending by the same Lands South seventy seven degrees West one hundred and thirteen perches to a Stone on Middle Creek thence down the said Creek on the several Courses thereof Sixty one Perches to a Stone thence by the other Part of the same Land of which this is part (then) intended to be granted to Abraham France North seventy six degrees East one hundred and five Perches and an half of a perch to a Stone thence by the same and land of the said Daniel Bollinger respectively North en degrees West fifty three Perches and an half of a perch to the place of Beginning containing by Computation twenty nine acres and an allowance in proportion to Six Acres perCent for Roads and Highways) were the same more or less and the other of them Beginning at a marked Black oak in a line of Land late of Jacob Weiss aforesaid then of the said Daniel Bollinger and thence extending by the same South fifty twodegrees West one hundred and forty three Perches to a marked Hickory thence by another Part of the same Land of which this is Part then intended to be granted to Abraham France aforesaid North sixty seven degrees East thirty five Perches to a stone South fourteen degrees East fifty two Perches to a Stone South Seventy seven Degrees West forty five Perches to a marked Hickory and South thirteen degrees East fifty Perches and an half of a perch to a Stone thence by other Land (then) of the said Abraham France East thirty seven Perches to a marked White oak thence by Land of Detrich Fahnstock North ten Degrees East ninety five Perches to a marked White Oak and North eighty four Degrees East Sixty Perches to a marked Black oak, thence by Land (the) of Weirich Pence North thirty degrees east forty seven perches to a Stone thence by another Part of the same Land of which this is part, then also intended to be granted to the said Abraham France North thirty eight degrees West fifty five Perches to the place of Beginning Containing by Computation forty two Acres and forty Perches of Land and Allowance were the same more or less with their Appurtenances To hold the said described two Tracts or Pieces of Land Containing together seventy one Acres and forty Perches and Allowance were the same more or less with their appurtenances unto the said Daniel Bollinger his Heirs and Assigns forever as in and by the said last recited Indenture recorded in the said Office for Recording of Deeds in and for the County of Lancaster in Book O Page 383 &c reference thereto being had may more fully and at large appear And Whereas the said Daniel Bollinger being so as aforesaid seised in his Demesne as of fee of and in the first above mentioned and described Tract or Piece of Land Containing one hundred and forty Acres and the Allowance as aforesaid and of and in the two last mentioned and described Tracts of Pieces of land one of them containing one hundred and forty Acres and the Allowance as aforesaid and of and in the two last mentioned nd described Tracts or Pieces of Land one of them Containing twenty nine acres and the Allowance as aforesaid and the other of them Containing forty two acres and forty perches and the allowance as aforesaid be the or either of them more or less with their Appurtenances died Intestate leaving a Widow named Elizabeth and Issue two Children to wit the said Peter Bollinger and Ann the wife of John Mohler to and amongst whom the same lands and Premises descended and came agreeable to the Acts of General Assembly of the said State of Pennsylvania in such cases made and provided Now this Indenture Witnesseth that the said John Mohler and Ann his wife for and in Consideration of the Sum of eight hundred Pounds Current Money of Pennsylvania in Gold and Silver Coin to them or one of them in hand well and truly paid by the said Peter Bollinger at and before the Sealing and delivery hereof (the Receipt and Payment whereof they and each of them do hereby acknowledge and thereof do acquit release and discharge the said Peter Bollinger his Heirs Executors Administrators and Assigns by these presents have and each of them hath granted bargained sold aliened enfeoffed released and Confirmed and by these presents do and each of them doth grant bargain sell alien enfeoff release and confirm unto the said Peter Bollinger his Heirs and Assigns All that the one full equal and undivided third part of them the said John Mohler and Ann his wife (in Right of the said Ann) of in to and out of the three Tracts or pieces of Land above mentioned and described (whereof the said Daniel Bollinger died Seised in fee as aforesaid)Situate and being in the Township of Cocolico in the County of Lancaster aforesaid one of them Containing one hundred and forty acres and the allowance of Six Acres perCent for Roads and Highways one other of them Containing twenty nine Acres and the Allowance in Proportion to Six Acres perCent for Roads and Highways be the same more or less and the other of them Containing forty two Acres and forty Perches and the Allownce in proportion to Six Acres perCent for Roads and Highways be the same more or less according to the Courses and distances bounds and Limits above set forth and expressed in respect to the same Lands And of in to and out of all and singular the houses outhouses Edifices and Buildings thereon erected and being and the Ways Passages Waters Water Courses Woods Underwoods Trees Fences Hedges Ditches Orchards Meadows Marshes Gardens Liberties Privileges Advantages hereditaments and Appurtenances whatsoever thereunto severally and respectively belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and also all that Part and Parts Share and Shares Purparty and Pruparties Estate and Estates Right Title Interest Use Trust Property Possession Claim and Demand whatsoever of them the said John Mohler and Ann his wife and each of them at Law and in Equity or otherwise howsoever of into and out of the same three Tracts or Pieces of Land above described Hereditaments and all and Singular the Premises hereby granted and released (or meant mentioned or Intended to be) with their and every of their Rights Members and Appurtenances as unto the said Peter Bollinger his Heirs and Assigns forever At and under the proportional Part of the yearly quit rent if any due and to become due for the same Premises to the Lord or Lords of the fee thereof and also Subject to the dower or thirds and Right and Title to Dower or Thirds of her the said Elizabeth the Widow and Relict of the said Daniel Bollinger deceased of and in the same Premises during the Term of her natural life And the said John Mohler and Ann his wife do hereby grant and Covenant for themselves and each of them and their and each of their Heirs the said one full & equal and undivided third part and all the Estate Right Title and Interest of them the said John Mohler and Ann his wife of in to and out of the three above mentioned and described Tracts or Pieces of Land Hereditaments and Premises hereby grnted and released (or mentioned or intended so to be) with their appurtenances unto the said Peter Bollinger his Heirs and Assigns against them the said John Mohler and Ann his wife and his and her Heirs and against all and every other Person and Persons whomsoever lawfully claiming or to claim by form or under him her or them or either or any of them shall and will warrant and forever defend by these presents And the said John Mohler and Ann his wife for themselves and each of them and their and each of their Heirs Executors and Administrators do and each of them doth covenant promise and grant to and with the said Peter Bollinger his Heirs and Assigns by these presents that they the said John Mohler and Ann his wife and his and her Heirs and all and every other Person and Persons whomsoever now having and lawfully claiming or hereafter to have and lawfully claim any Estate Right Title or Interest whatsoever of in to or out of the said three Tracts or Pieces of Land above described and Premises or any Part or Parts thereof by from or under him her or them or either or any of them shall and will from time to time and at all Times hereafter upon the request and at the proper Costs and Charges in the Law, of the said Peter Bollinger his Heirs or Assigns make do execute acknowledge and deliver or cause or procure to be made done executed acknowledged and delivered all and every such further and other lawful and reasonable Act and Acts Deed and Deeds Devices Conveyances and Assurances in the Law whatsoever for the further better more sure prefect and absolute granting Conveying assuring and confirming the one full equal and undivided third part and all the Part Share and Purparty Estate right Title and Interest whatsoever of them the said John Mohler and Ann his wife of in to and out of the said three Tracts or Pieces of Land above described Hereditaments and Premises hereby granted and released (or mentioned or intended so to be) with their Rights Members and Appurtenances unto the said Peter Bollinger his Heirs andAssigns forever as by him or them or his or their Council learned in the Law shall be lawfully and reasonably advised or devised and required In witness whereof the said Parties to these presents
