THIS INDENTURE made this twenty second day of February in the year of our Lord one thousand seven hundred & forty and nine fifty 1749/50 BETWEEN Henry Moler of the county of Lancaster and Province of Pennsylvania yeoman of the one part & Jacob Graff of the same place yeoman of the other part whereas John Penn Thomas Penn and Richard Penn true and absolute Proprietaries and Governors in Chief of the Province of Pensylvana & counties of New Castle Kent & Sussez on Delaware by their patent bearing date the twenty eighth day of September in the year of our Lord one thousand seven hundred and thirty six for the consideration therein mentioned did grant and confirm unto the said Henry Mohler and his heirs and assigns forever a certain tract of land scituate on the branches of Cocolico Creek in the said county containnig one hundred & forty acres and an allowance proportionable to six acres per cent entered in Pat Book A, vol. 8, page 98 the 15th day of November Ano Dom 1736 Know ye that I Henry Moler do for and in consideration of the sum of eight pounds current money of Pennsylvania to me in hand paid by Jacob Graff the receipt whereof I do hereby acknowledge and thereof do acquit and forever discharge the said Jacob Graff his heirs and assigns forever by these presents and also for the yearly quit rents hereafter mentinoeed & reserved I have given granted released & confirmed and by these presents do for me my heirs and successors give grant release & confirm unto the said Jacob Graff and his heirs and assigns forever A certain parsel or piece of the above mentioned deeded land bounded and limited as hereafter set forth Beginning at a post at a corner of the said Henry Molers land thence south east by the same 76 perches to a post thence north sixty six degrees east twenty one perches to a post thence north forty two degrees east eighty perches to a white oak thence north west ninety perches to a post thence south forty degrees west by the land late of John Whites 100 perches one hundred perches to the place of begining. Containing fifty acres and an allowance proportionable as abovesaid with all mines mineral quarries medows marshes savannahs swamps cripples woods undersoods timbbers and trees was waters and water courses libertys profits comodities advantages hereditaments & appurtenances whatsoever to the said fifty acres of land belonging or in any wise appurtaining & lying within the bounds and limits afforesaid three full and clear fifth part of all royal mines free from all deductions and reprisals for diggin and refineing the same also one fifth part of all the oar of all other mines delivered at the pits mouth only excepted and hereby reserved and also free leave and right and liberty to and for the said Jacob Graff his heirs and assigns to the only use and behoof of the said Jacob Graff his heirs and assigns forever
TO HAVE AND TO HOLD the said fifty acres of land and premisses hereby granted except as before excepted with the appurtenances unto the said Jacob
Graff his heirs and assigns forever to be holden of us our heirs and succesors proprietaries of Pennsylvania as of the Manor of Constogoe in the county of Lankaster afforesaid in a free and common soccage by fealty only in Lieu of all other services yeilding and paying therefore yearly to us our heirs and successors at the twon of Lancaster at or upon the first day of March in every year from the first survey thereof one half penny sterling for every acre of the same or value thereof in coin current according as the exchange shall be then between our said Province and City of London to such person or persons as ashall from time to time be appinted to received the same and in case of non payment thereof withiin ninety days next after the same shall become due that then it shall and may be lawfull for Ye said Proprietarys to or their heirs or successors then or their receivers into and upon the hereby granted land and premisses to reenter and the same to hold and possess untill the said quit rent and all arrears thereof together with the charges accruing by means such non payment and reentry afforesaid be fully paid and discharged
IN WITNESS whereof the said Henry Moler by the property and patent granted to him by the proprietarys aforesaid doth seal sign and confirm the same this twenty second day of February in the year of our Lord one thousand seven hundred and fourty nine fifty the twenty third year of the reign of George the secon over Great Britain &c. Parsanaly appeared befor me Emanuel Carpenter one of the Justice of the Peace for the county of Lancaster the within named Henry Moler and acknowledged the due execution of the within deed and desired that the same might be recorded as such In testimony whereof I have hereunto set my hand and seal this 6th day of Aprill 1750. NOTES: The above Indenture inappropriately references the 1736 Patent using the date of the return of the survey, November, 1745, as opposed to the date of the patent itself, April, 1747. by Derber
