Thomas BAY was in Orange, (in what became Frederick and Shenandoah) Co., VA
by 1739 when he witnessed two deeds.6 In 1745 Thomas, Hugh and
William BAYS were all added to the tithables list of Frederick Co. for the
year.1

To date, five descendants of Thomas BAY have DNA tested, with their results
being that the BAY family belongs to haplogroup I2b1.
The widow (name unknown) of Thomas BAY (Sr.) married secondly William
STEPHENSON9 and was deceased before he wrote his will 31 July 1782.11 The will
was probated on 28 April 1785, and he named two children, James STEPHENSON,
and Mary NEWELL, wife of Samuel NEWELL. Also named were grandchildren
William NEWELL, James NEWELL, Jean NEWELL, Martha NEWELL, Mary NEWELL,
and Marget NEWELL. The grandsons were to receive their legacies at age 20,
and the granddaughters at age 17. Whether they are children by the widow
of Thomas BAY, or an unknown first wife is uncertain.

Benjamin Blackburn (father of Thomas [Jr.'s] wife Elizabeth, see #10)
was a close neighbor of the Bay family. Joseph Keller 1764 grant

Stephens, Daniel Curry, and Benjamin Blackburn.

21 July 1795 "Thomas Bay, David Bay, Robert Bay, James Wilson and Samuel
Wilson her husband, Mary McKay and David McKay her husband, Isabella
Crawford and Robert Crawford her husband, Elisabeth Stewart and William
Stewart her husband "being Brothers and Sisters Heirs and Heires's of
the late William Bay of the County of Westmoreland..." Co., PA sold a tract
owned by Willam Bay, deceased. Though no father is stated, evidence
that they are children of Hugh [Sr.] includes that Robert stated he
was born on "Seder" [Cedar] Creek in Virginia in 1760. [see #15] The
only Bay family members of which there are records of living on Cedar
Creek at that time were Hugh Bay and William Bay. [see #2b, among other
land records.] William died with no children. [see #9] While Thomas
Bay (brother to Hugh and William) did have a son Robert Bay, he is not
the Robert of record #15. By elimination, the conclusion is that these
"brothers and sisters" were children of Hugh Bay. The various heirs
either acknowldeged the deed or witnesses testified to their signing
over the next several years.

a) He owned land adjacent to Hugh [Sr.] in Westmoreland Co., PA.
Hugh [Sr.] application 3348, 13 June 1769. [Pennsylvania original
surveys, D70:247, FHL microfilm 1,006,491] This is tract 6 at
Joiners of William Latta. Hugh [the younger] had tract 8 at the above
site. [PA original surveys, C6:104, FHL microfilm 1,004,624, see
also D57:258 & D57:259, FHL microfilm 1,006,478].
b) Hugh appeared in Mt. Pleasant Twp., Westmoreland Co., PA tax lists
[FHL microfilms 1,027,065, item 2, and 1,027,066] with David and
William Bay. Hugh and David appeard in 1783, (no 1784 list), 1785,
1786, 1787, 1788, and 1789. William in 1783 only [listed as "single"].
c) Hugh gave a deposition in the 1784 case of John Dickey vs. William
Bay in Westmoreland County. ["Westmoreland Co., PA Civil Court Records,
Continuance Docket 1," Old Westmoreland Vol. 9, No. 3, (Feb. 1990):16].
d) Hugh appeard in Bourbon Co., KY tax lists with Thomas, David, Robert
and James Bay. [Bourbon Co., KY tax lists, FHL microfilm 0,007,879.
